Helping San Antonians Protect Their Rights Under ERISA

Prior to the 1970s, there were few protections for pension holders. The collapse of a company meant hundreds — even thousands — of employees could see their retirement plans wiped out, leaving them with little to no financial safety net. This was the case until 1974 when the president signed the Employee Retirement Income Security Act, also known as ERISA.

Through revisions over the years, ERISA has expanded to protect insurance plans, the Health Insurance Portability and Accountability Act (HIPAA), the Consolidated Omnibus Budget Reconciliation Act (COBRA), as well as several other acts that protect mothers, people with cancer, and those living with mental health issues.

Even though ERISA is designed to provide legal protections for employees with pension and insurance plans through their employers, a complex web of state and federal laws make it difficult for people to collect their benefits. When state and federal laws clash, The Law Office of Jessica Taylor, PLLC, is able to resolve legal matters.

What Is ERISA?

ERISA is a federal law that regulates the minimum standards by which employers in the private industry set up and maintain pension and insurance plans. Under ERISA, plans must:

  • Provide plan participants with information about plan features and funding
  • Explain fiduciary duties for those in charge of managing and controlling plan assets
  • Establish a grievance and appeals process for participants looking to gain access to their benefits
  • Give participants the right to sue if there is a breach of fiduciary duty

I Will Help You Protect Your Rights

Even though you have rights under ERISA, a complex network of state and federal laws, differing interpretations in court cases and complicated policy language are all working against you. You deserve access to your benefits and I will fight to help you get them.

For the past two decades, I, attorney Jessica Taylor, have helped people in the San Antonio area file appeals and seek litigation in order to gain access to their health and retirement benefits. In addition to helping plan participants, I also help doctors and physicians provide the right information on ERISA claims.
